1. Acceptance of Terms

These Terms of Use govern your access to and use of https://aquariusadventures.com/ and your booking of guided kayaking and related experiences offered by Aquarius Adventures (also operating as Aquarius Kayaking) (“we”, “us”, “our”). By using the Website or booking an experience, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Website or make a booking.

2. About Our Services

We offer guided kayaking tours in the Kadamakkudy backwaters near Kochi, Kerala, including experiences such as mangrove exploration, bird watching, village and backwater experiences, and related activities. Inclusions typically listed on our website are a kayak and paddle, a certified life jacket, a local guide, candid photography, and refreshments. Exact inclusions, duration and group size for each package are as stated on the Pricing page or confirmed at the time of booking.

Tour timings are currently [Morning 6:00 AM to 8:30 AM and Evening 4:00 PM to 6:30 PM] and may change based on tide, weather and operational needs.

3. Bookings

Bookings can be made through the Book Now page, by phone, or by WhatsApp. A booking is confirmed only when we send you a confirmation.
You must provide accurate information, including the number and ages of participants.
Bookings for minors must be made by a parent or legal guardian, who is responsible for the minor’s participation and conduct.
We recommend advance booking, especially for weekends and sunset slots, as slots are limited.
We reserve the right to decline or cancel any booking where information is inaccurate, safety rules are not accepted, or we cannot operate.

4. Pricing and Payment

Prices are displayed in Indian Rupees (INR) and are per person unless stated otherwise [confirm].
Prices, packages, and offers may change without prior notice. The price confirmed at the time of booking applies to that booking.
Prices [include / exclude] applicable taxes.
Payment is accepted by (cash / UPI / card / bank transfer).

5. Cancellations, Rescheduling and Refunds

Cancellation by us: If we cancel a tour due to weather, water or tide conditions, safety concerns, or circumstances beyond our control, you may reschedule to another available slot or receive a refund of the amount paid for that booking.
Refunds: Refunds are processed to the original mode of payment within 7 to 10 working days.
Late arrival: Late arrival may shorten or forfeit the slot without a refund, as tours run on fixed timings.

6. Participant Eligibility, Health and Safety

Kayaking is an outdoor adventure activity and involves inherent risks, including capsizing, contact with water, weather changes, uneven terrain at entry and exit points, and encounters with wildlife.

By participating, you agree that:

You will attend the safety briefing and follow all instructions given by our guides at all times.
You will wear the life jacket provided throughout the activity.
Participants should be in reasonable health. If you have a medical condition, are pregnant, have a heart or back condition, or have any other condition that may affect your safety, you must inform us before booking and consult your doctor. We may refuse participation where we believe it is unsafe.
Participants must not be under the influence of alcohol or drugs. We may refuse or end participation for anyone who is.
Our tours are beginner-friendly, and non-swimmers are welcome with the safety gear provided. However, you must tell us about your swimming ability and any fears or concerns so that we can assist you appropriately.
Participants under 18 must be accompanied and supervised by a parent or guardian.
You will not leave the group or the designated route, or engage in reckless behaviour.
You may be asked to sign a participation or liability waiver before the activity.

We may modify, shorten or stop any activity at the guide’s discretion for safety reasons, without liability for the change.

7. Weather and Natural Conditions

Backwater conditions depend on weather, rain, tides and water levels. We provide rain gear for light showers, but may suspend tours in heavy rain, thunderstorms, strong currents or other unsafe conditions. Where we suspend a tour, Section 5 applies.

8. Assumption of Risk and Limitation of Liability

You take part in activities at your own risk and acknowledge that adventure activities carry inherent risks, even when reasonable precautions are taken.
To the maximum extent permitted by law, Aquarius Adventures, its owners, employees, and guides are not liable for any injury, illness, death, loss, or damage to person or property arising from your participation, except where caused by our proven negligence or wilful misconduct, and nothing in these terms excludes liability that cannot be excluded under applicable law.
We are not responsible for loss of or damage to personal belongings such as phones, cameras, wallets, jewellery, and keys. Please leave valuables safely or use waterproof protection at your own risk.
You are responsible for damage to kayaks, paddles, or other equipment caused by your negligence or misuse.
Where liability is established, our total liability will not exceed the amount you paid for the booking, to the extent permitted by law.

9. Photography and Media Consent

We provide complimentary candid photography. By participating, you agree that photographs and videos taken during your tour may be used by us on our website, social media and marketing material. If you do not want to be photographed or featured, tell your guide before the tour or write to info@aquariusadventures.com. Please see our Privacy Policy for details.

10. Conduct and Environmental Responsibility

Please respect the local community, wildlife and the mangrove and backwater environment. Do not litter, damage vegetation, disturb birds or animals, or trespass on private property such as fields and farms. We may end your participation without refund if your behaviour endangers others, damages property or the environment, or disregards guide instructions.

11. Website Use

You agree to use the Website only for lawful purposes. You must not:

Attempt to gain unauthorised access to the Website, its servers, or data.
Introduce viruses, malware, or harmful code.
Scrape, copy, or reproduce Website content for commercial purposes without our written permission.
Submit false, misleading, or abusive information, or impersonate another person.
Use the Website in any way that violates applicable law.

12. Intellectual Property

All content on the Website, including text, logos, graphics, images, videos, design and layout, is owned by or licensed to Aquarius Adventures and is protected by Indian and international intellectual property laws. You may view and share Website content for personal, non-commercial use with proper credit, but you may not modify, reproduce, distribute or commercially exploit it without our prior written consent.

Reviews or content you submit to us may be displayed on our Website and channels, and you grant us a non-exclusive, royalty-free right to use them for that purpose.

13. Accuracy of Information

We try to keep the Website accurate and up to date, but we do not guarantee that all information, including prices, timings, availability, inclusions and reviews, is complete or error-free. Statements about experience, ratings and the number of guests served are provided for general information. In case of conflict, the confirmed booking details prevail.

14. Third-Party Links and Services

The Website may link to third-party services such as Google Maps, Google Reviews, WhatsApp, Facebook, Instagram and YouTube. We do not control or endorse them and are not responsible for their content, availability or policies.

15. Website Availability

We do not guarantee that the Website will be available at all times or free from errors or interruptions. We may suspend, modify or discontinue any part of the Website without notice.

16. Indemnity

You agree to indemnify and hold harmless Aquarius Adventures, its owners, employees and guides from claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of equipment, your violation of any law, or your misconduct during an activity.

17. Force Majeure

We are not liable for failure or delay in providing services due to events beyond our reasonable control, including floods, extreme weather, natural disasters, government orders, restrictions, strikes, epidemics or other emergencies.

18. Governing Law and Jurisdiction

These terms are governed by the laws of India. Subject to any mandatory consumer protection rights, the courts at Ernakulam, Kerala shall have exclusive jurisdiction over any dispute arising from these terms or your use of the Website or our services.

19. Changes to These Terms

We may update these Terms of Use from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Website or our services after changes means you accept the revised terms.
